Court Dispositions on Felony Cases
Timothy Morris Jr. of Sioux Rapids was convicted in Buena Vista Co District Court on Monday March 22, 2010 on a charge of "Delivery of a simulated controlled substance”, a Class C Felony. Morris was sentenced to up to ten (10) years in prison, $1000 fine, $485 in surcharges and ordered to pay restitution to Storm Lake Police in the amount of $140 and Buena Vista Co Jail for room and board in the amount $4070. The 10 year prison sentence was totally suspended and Morris was place on 5 years probation. The $1000 fine was also suspended as well as $350 of the surcharge.

On Monday March 15th, 2010 a plea agreement was reached between the Buena Vista County Attorney’s Office and defendant Andre Miles on a Burglary 3rd degree (class D felony) and a Criminal Mischief 3rd degree (class D felony). The plea agreement reduced the class D felony charge to an aggravated misdemeanor. The criminal mischief charge stems from over $4,000 damage that Miles caused while in the Buena Vista County Jail. As part of the plea agreement, Miles was released immediately with credit for 345 days time served in the Buena Vista County Jail. As a result of the 345 days, Miles was ordered to pay the Sheriff’s Office $18,975 for room and board, as well as restitution for damages to the jail. Medical costs for Miles also amounted to over $31,000 while he was held in jail.

On Monday March 8th, 2010, Edward Armstrong III
was convicted in Buena Vista County District Court to three counts of
Burglary
3rd degree and sentenced to a term of 2 years each. Armstrong was transported on
Friday March 12th, 2010 by the Buena Vista County Sheriff’s Office to the Iowa
Department of Corrections in Oakdale (Iowa City), IA. On the following Monday
March 15th, Armstrong was released from prison and was given credit for 122 days
served in the Buena Vista County Jail at a cost of $6,710.
